Saddlebrook Village is a single-family residential HOA in Frisco, TX. This document is an amendment to the community's CC&Rs, approved by a 67% membership vote, that updates rules on occupancy, home businesses, noise, trash storage, parking, garages, architectural control, and adds a mandatory dispute-resolution process. It is not the full set of rules; the original Declaration and other amendments still apply.
- Occupancy & home businesses: Single-family homes may be occupied by any number of related individuals plus up to one unrelated person, or by no more than two unrelated individuals (living as a household unit). Home-based businesses are allowed if they comply with conditions like no public solicitation, no visible signs, no noticeable traffic, and no machinery beyond typical household equipment.
- Noise & nuisances: No noise or other nuisance is permitted that disturbs other residents. The association may adopt rules limiting noise-producing activities and may enter property to terminate such noise, including silencing burglar alarms.
- Trash & recycling: Trash and recycling containers must be stored inside the garage, behind the residence or fence (out of view from streets and neighbors), or screened with fencing/plants. They may be placed at the curb no earlier than 24 hours before pickup and must be removed within 12 hours after pickup.
- Landscaping & exterior changes: Landscaping must be kept alive and weed-free; tree removal requires Architectural Control Committee (ACC) approval. Repainting or restaining a home's exterior does not require ACC approval as long as the new color is substantially the same as the existing color.
- Parking, vehicles & garages: Commercial vehicles (over 7,500 lbs gross weight), RVs, boats, trailers, stored or inoperable vehicles must be kept in enclosed garages or behind fences out of view from streets and neighbors. Each home must have a private garage for at least two standard-size cars, and the garage cannot be permanently converted to another use.
- Architectural control (ACC): Any construction or alteration visible from a street, another lot, or common area requires prior written ACC approval. The ACC consists of up to three members appointed by the Board, may charge review fees, and operates under Design Guidelines that the Board can adopt or modify; the Declaration controls in any conflict.
- Dispute resolution: Before filing suit over most claims, parties must follow a mandatory process: written notice, negotiation within 60 days, and mediation (if unresolved, within 30 more days). Exceptions exist for assessment collection, injunctions, and enforcement of use restrictions. The association must obtain majority owner approval to litigate (with some exceptions) and fund litigation through a special assessment.
