They are not community-wide HOA rules but rather ancillary agreements between the original builder (Sotherby Homes) and the lot owner that run with the land. Their purpose is to waive implied warranties on the home and to require mediation/arbitration for construction disputes. - Dispute resolution: mediation & arbitration: Any dispute arising from construction, design, warranties, or the sale must first be mediated through the American Arbitration Association (AAA). - Property accepted 'as is': The owner acknowledges the improvements are complete as accepted, takes the property 'AS IS, WITH ALL FAULTS,' and releases the builder from all claims except those under the express limited warranty.
- Agreement runs with the land: This covenant binds the original owner and all future owners of the property, their heirs, successors, and assigns. It is recorded in the county real property records.
- What this document doesn't cover: This document does not address typical HOA or neighborhood rules such as leasing restrictions, pet limits, parking, architectural guidelines, common area maintenance fees, or any other community-wide standards. Those would be found in the subdivision's separate declaration of covenants, conditions, and restrictions (CC&Rs), which are not included here.
