This is a Declaration of Covenants, Restrictions, and Easements for T M Hood, a commercial subdivision in Southlake, TX. It governs the use and maintenance of lots and common property, and binds all lot owners (businesses or investors). Residential use is not permitted.
- Permitted use: Lots may be used for commercial purposes only. No residential or unlawful uses are allowed.
- Assessments: Each lot owner pays a pro rata share of annual assessments, which fund maintenance of common property and operations. Annual assessments may increase by no more than 10% over the prior year without a majority owner vote. Special assessments may be levied for capital improvements or unanticipated expenses.
- Maintenance responsibilities: The Property Manager maintains all common property (landscaping, sidewalks, driveways, parking, signs). Each lot owner must keep their own lot and structures in good condition and repair.
- Signage: A monument sign at the development entrance is maintained by the association. Each owner may install a panel on it at their own expense. Exterior building signage requires written approval from the Declarant.
- Leasing: Leases of lots or portions must require tenants to comply with the Declaration's rules (except payment of assessments). Violations by tenants are enforceable against the owner.
- Enforcement and liens: The Property Manager can enter lots to abate violations and charge the owner (plus 18% interest and legal fees). Unpaid assessments become a lien on the lot, superior to most other liens except taxes and certain mortgages.
- Duration and amendments: The Declaration runs for 25 years from October 2005, with automatic 10-year renewals. It can be terminated by Declarant plus majority of owners, or by two-thirds of owners if Declarant no longer owns a lot. Amendments require majority approval (or two-thirds if Declarant no longer owns), plus mortgagee approval if materially affecting lien status.
