It is NOT a community association's full rulebook—it focuses on construction defects, warranties, and dispute resolution, and it 'runs with the land,' binding future owners. The document does not contain typical HOA rules about pets, parking, architectural review, or common-area maintenance.
- Dispute resolution (mandatory arbitration): Any dispute between owner and builder (including contract, warranty, tort, or personal injury claims) must first go to mediation, then to binding arbitration under the Federal Arbitration Act, not to court. The owner's initial arbitration costs are capped at what court filing would cost.
- Warranty limitations and waiver of implied warranties: The builder gives only an express written limited home warranty; all implied warranties (including good and workmanlike construction) are waived. The owner acknowledges that the limited warranty sets the only construction standards the builder must meet.
- Mold disclaimer and release: The owner releases the builder from all claims related to mold, chemicals, or biological impurities at the property, including personal injury and property damage. The owner also waives subrogation rights for their insurance carrier against the builder.
- Builder's repurchase right: If the reasonable cost to repair a construction defect exceeds 20% of the improvement's fair market value (ignoring the defect), the builder may elect to repurchase the property under Texas Property Code Section 27.004.
