Piester Place is a single-family subdivision in Joshua, TX, governed by restrictive covenants (no HOA). These deed restrictions bind all owners and are enforceable by any property owner and an Architectural Control Committee. The covenants include minimum lot and dwelling sizes, animal limits, architectural review, and prohibitions on businesses and certain vehicles.
- Minimum lot & dwelling size: Each dwelling must be on at least one acre, and no two main dwellings may share the same acre. Every main dwelling must have a living area of at least 1,000 square feet, excluding porches and garages.
- Animals & livestock: Animals must be kept in fenced enclosures. The maximum number of animals is one per acre owned (e.g., 9 acres = 9 animals), but owners may keep up to 10 chickens, up to 3 cats and/or dogs, and no fighting roosters or swine. Horse-related activities are not considered nuisances.
- Architectural review: All new structures, alterations, and manufactured homes require prior written approval from the Architectural Control Committee as to quality, design, and location. If the committee fails to act within 30 days after plan submission, or if no lawsuit is filed before construction is complete, approval is deemed given. The committee may also waive any restriction.
- Parking & vehicles: No truck, bus (except personal passenger van), boat, or trailer may be parked on the street in front of any property, except construction equipment during building/repair. Such vehicles also cannot be parked on any portion of the property if visible from a street (unless located at least 250 feet from the street). All vehicles must have current license, registration, and inspection.
- Businesses & signs: Engaging in a trade or business (except as specifically allowed, like livestock sales) is prohibited, as is any activity that becomes a nuisance. Signs or billboards for advertising are prohibited, except 'owner's business' signs (likely an exception for home-based businesses).
- Maintenance & nuisances: Grass, weeds, and vegetation must be kept mowed regularly. If not, the Architectural Control Committee may cut them and charge the owner (creating a lien). No trash, ashes, or residue may be dumped or left on the property. No obnoxious or offensive activities are allowed.
- Term of covenants: These covenants run with the land for 30 years from the date of recording, automatically renewing for 10-year periods unless two-thirds of owners (by acreage, not number) vote to change them.
