Thomas Acres Subdivision is a single-family residential subdivision in Johnson County, Texas. These covenants and restrictions apply to lot owners, not a homeowners association. Enforcement is by the developer or any individual lot owner. The rules govern lot use, building standards, animals, and prohibited activities.
- Lot use & building standards: Lots are for single-family residential use only. Main dwellings must have at least 1,000 square feet (excluding porches, garages, carports). Mobile or modular homes are allowed with prior written approval from the developer and must be skirted within 90 days. Setbacks: no structure within 50 feet of front property line or 10 feet of side property lines.
- Animals & livestock: No hogs, pigs, swine, or poultry are allowed. Up to two domestic horses or cattle are permitted, but must be kept on the rear one-half of the lot. No commercial feedlots or livestock operations.
- Prohibited uses & activities: No wrecking yards, junk storage, or inoperative vehicles. No secondhand houses moved onto lots. No church or massive religious gatherings, gun clubs, commercial riding stables, or mining. Firearms are prohibited within the subdivision. No dumping of rubbish or waste.
- Easements & roadways: Public utility easements are shown on the plat. The developer reserves a 10-foot easement along lot lines for utilities. A 30-foot private roadway easement exists for lot owners' ingress/egress; no public roadway may be opened over any portion of the properties.
- Duration & enforcement: The covenants run for 25 years from recording (1986) and automatically renew for successive 10-year periods unless an instrument signed by two-thirds of lot owners changes them. Enforcement may be by the developer or any lot owner, and failure to enforce does not waive future enforcement.
