What Oakbrook On's governing documents say
Oakbrook on the Lake is a single-family home community in Hickory Creek, TX, governed by a homeowners' association (HOA). These restrictive covenants apply to all lot owners and require compliance with rules on property use, maintenance, assessments, and architectural standards. The HOA maintains common areas and exterior building maintenance, funded by annual and special assessments.
- Property use restrictions: Lots are for single-family residential use only. No business, commercial, or multi-family use is allowed. Livestock, poultry, and noxious activities are prohibited.
- Architectural review: All exterior improvements (buildings, fences, patios, landscaping changes, repainting) must be approved in writing by the Architectural Committee. Plans must be submitted; if the committee fails to act within 45 days (meeting within 15, decision within 30), the project is deemed approved.
- Assessments & fees: Annual assessments are set by a two-thirds vote of members. Special assessments (up to twice the annual amount) may be levied for capital improvements or enforcement. Unpaid assessments accrue 18% interest and become a lien on the lot with foreclosure rights.
- Common areas & amenities: The HOA manages common areas including recreational facilities. Owners have a nonexclusive easement to use them, subject to rules. The HOA may charge fees for use of amenities. The developer initially controls common areas but must convey them to the HOA when 85% of lots are sold or initial improvements are completed.
- Right of first refusal on sales & leases: If an owner receives a bona fide offer to buy or lease their lot, they must notify the HOA, which has 20 days to match the offer. Any sale or lease made without giving this right is void.
- Party walls & maintenance: Where attached townhouses exist, party walls are shared. Each owner must maintain the wall's integrity; damage from negligence is borne by the responsible owner; otherwise, repair costs are shared equally.
- Parking & vehicles: No trucks, campers, vans, commercial vehicles, boats, or vehicles being repaired may be stored on lots or streets except in a closed garage. Parking on streets is only for active loading/unloading.
- Signs & antennas: No signs or billboards are allowed except developer sales signs. Exposed TV antennas are prohibited unless approved. Radio transmitting devices and exterior radio antennas are banned.
