What Oaks Preserve Ph I's governing documents say
The Oaks Preserve is a single-family home subdivision in Mansfield, TX, governed by a Homeowners Association (HOA). These Covenants, Conditions, and Restrictions (CC&Rs) apply to all lot owners and residents, covering property use, architectural control, and mandatory assessments.
- What you own & maintain: You own your lot and the single-family home on it. You must maintain the home, landscaping, and all improvements. The HOA maintains common areas (if any) funded by assessments.
- Leasing & rentals: Rentals are allowed only for terms of at least one month. The HOA Board may adopt additional rental rules.
- Pets: No more than four cats and dogs in total per lot. Prohibited animals include livestock, poultry, and any dog declared dangerous. Pets must be leashed off your lot and kept in approved screened enclosures.
- Architectural review: All exterior changes (construction, fences, painting, landscaping) require prior written approval from the Architectural Committee. Plans and specifications must be submitted. The committee can grant variances.
- Parking & vehicles: No overnight parking on roadways. Boats, trailers, campers, and inoperable vehicles must be screened or stored in enclosed structures. Commercial vehicles larger than a 3/4-ton pickup or standard van are not allowed to remain visible.
- Minimum home size & materials: Dwellings must have at least 3,000 square feet of air-conditioned space. Exterior walls must be mostly masonry (brick, stone, stucco) – one-story homes require masonry on front and sides; two-story homes require masonry on first floor front and sides. Reflective roofing is prohibited.
- Assessments & fees: Regular annual assessments are levied uniformly on improved lots. Annual increases capped at 15% without a two-thirds owner vote. Unpaid assessments become a lien and can be foreclosed upon. Interest on delinquent amounts is 10% per year.
- Use restrictions: Lots are for single-family residential use only. No hazardous activities, open fires (except in barbecue units), firearms discharge, mining/drilling, or nuisance noise/lighting. Basketball goals must be set back 25 feet from curb.
