These documents are supplemental to the full governing documents of Dominion of Pleasant Valley, a single-family home subdivision in the Dallas-Fort Worth area (addresses in Wylie and Plano, TX). The first is a restrictive covenant for a specific lot, primarily imposing mandatory arbitration for disputes with the builder. The second is a board resolution establishing community-wide policies on records, payment plans, flags, rainwater systems, and religious displays.
- Dispute resolution (arbitration): Any claim against the seller or builder must be resolved through binding arbitration under the Federal Arbitration Act, administered by the AAA. The holder waives jury trial and agrees that the seller may join subcontractors in arbitration.
- Flag display guidelines: Permitted flags include the U.S. flag, Texas flag, military flags, and flags with seasonal, historical, or religious themes. Flags must be displayed from a pole (attached or free-standing) at least 14 ft tall, no larger than 3x5 ft. Free-standing flagpoles require architectural committee approval and must meet setback and height restrictions.
- Rainwater recovery systems: Rain barrels and cisterns are permitted with architectural committee approval. Components must be screened from public view (behind fence, vegetation, or buried). Visible rain barrels are limited to 55 gallons and must be painted to blend with the home.
- Religious items display: Religious items may be displayed without architectural committee approval as long as they do not threaten public safety, violate law, or contain patently offensive language or graphics.
- Records production & copying: Owners may request to inspect or copy association records. Requests must be in writing and sent by certified mail. Copy costs follow Texas Administrative Code: $0.10 per page for standard copies, plus labor and retrieval charges for larger requests.
- Payment plans for delinquent assessments: Owners who are not in default on a previous payment plan within the past two years may request a payment plan. Minimum term 3 months, maximum 18 months. Default results in immediate full balance due, no notice or cure opportunity.
- Document retention: The association retains records for specified periods: account records of current owners (5 years), contracts over one year (4 years after expiration), meeting minutes (7 years), tax returns and audit records (7 years).
