What Creekwood Country Estates's governing documents say
Creekwood Country Estates is a standard single-family home HOA in Dallas, TX. These Bylaws define how the Property Owners Association (POA) is run, not the full set of rules for homeowners. They are meant for homeowners and board members to understand meeting procedures, board structure, and enforcement processes.
- Membership & Voting: Membership in the POA is tied to lot ownership. Each lot owner has one vote, but the developer (Declarant) gets 5 votes per lot owned until no longer owns any lot. You must not be delinquent on assessments to be a Voting Member.
- Annual & Special Meetings: Annual meetings are held on the first Sunday in March. Special meetings can be called by the president, the Board, or by a petition of 10% of Voting Members. Written notice of meetings must be given 10 to 21 days in advance.
- Quorum Requirements: A majority of Voting Members constitutes a quorum. If no quorum, the meeting can be adjourned; at the adjourned meeting, 40% of Voting Members is a quorum. If still no quorum, a majority of the Board is a quorum for that reconvened meeting.
- Board of Directors: The Board has 3–7 directors, each serving staggered 3-year terms. Directors must be lot owners (or a designated representative). They serve without compensation but may be reimbursed. Directors can be removed by a majority vote of Members for cause (e.g., missing meetings, delinquent assessments, enforcement actions).
- Officers: Officers (president, vice president, secretary, treasurer) are elected annually by the Board from among the Members. The president is the CEO; the treasurer handles budget and financial reports.
- Enforcement & Hearings: Before the Board can suspend common area use, file suit (except for assessment collection), foreclose a lien, charge for damage, or levy a fine, the POA must give the owner written notice by certified mail. The notice must describe the violation, allow a reasonable cure period, and inform the owner of the right to request a hearing within 30 days. The hearing must be held within 30 days of the request, with at least 10 days' notice. The owner may appeal a committee decision to the Board within 3 days.
- Record Inspection: Any Member may inspect and copy POA books and records for a proper purpose upon written request, subject to reasonable rules and cost reimbursement. Directors have broader inspection rights at reasonable times and at POA expense.
- Amendment of Bylaws: These Bylaws can be amended by a vote of 50% of all Voting Members in the POA. The Board may change enforcement procedures to comply with law changes.
