Chapel Trails is a standard single-family homeowners association (HOA) in Princeton, TX. This declaration governs all Lot owners and establishes the HOA, assessments, architectural controls, and property rights. The Declarant retains significant control until the 10th anniversary of recording.
- Assessments & fees: Annual assessments set by the Board; increases up to 10% need no vote; larger increases can be vetoed by 67% of members. Special assessments require a 67% vote. Specific assessments may be levied per Lot for violations or unpaid fines. A one-time working capital assessment is due upon purchase. Assessments are a personal obligation and a continuing lien on the Lot.
- Architectural review: All exterior improvements (buildings, fences, landscaping, pools) need prior written approval from the Architectural Control Authority (ACA). No above-ground pools allowed. During the Development Period, the Declarant acts as ACA; thereafter an Architectural Committee appointed by the Board.
- Board control & voting: Declarant appoints all Board members until the 10th anniversary of recording; thereafter, one-third of the Board is elected by owners (other than Declarant) at the Initial Member Election Meeting, with Declarant continuing to appoint two-thirds until Development Period ends. Each Lot gets one vote; Declarant gets four extra votes per other vote during Development Period.
- Property rights & restrictions: Owners have non-exclusive easement to use Common Areas, but rights can be suspended for unpaid assessments or violations. Mineral interests and water rights were reserved by prior owners and are superior. No partition of Common Areas. Common Areas may be sold or mortgaged only with 67% approval.
- Enforcement powers: Association may impose fines, suspend voting and Common Area use, enter Lots for self-help (abatement), require removal of violating structures, levy specific assessments, and file lawsuits. Written notice and hearing required as per Texas Property Code.
- Insurance: Association must carry property insurance on Common Area improvements and general liability insurance. Board may add additional coverage (D&O, fidelity, etc.).
