Bent Oaks Addt (Rendon, TX) is a single-family subdivision governed by restrictive covenants recorded in 1988, not an HOA. These covenants run with the land and bind all lot owners. There is no association, no common property, and no annual assessments. The rules focus on construction standards, land use, and maintenance.
- Land use & activities: Only single-family residential use; no commercial activity. No livestock. Up to 2 dogs or 2 cats allowed, kept contained by fence or leash. No burning of trash; garbage must be stored in sanitary containers and removed within 7 days. No noxious or offensive activities.
- Construction & building standards: Homes must be at least 1,750 sq ft (excluding garage/porch/patio) and 2,500 sq ft for ground or split-level designs. Exterior walls must be at least 80% brick, masonry, stucco, or glass. Roof pitch must be at least 12/12. Outbuildings allowed but must complement the house. Construction must start within 9 months of purchase and be completed within 9 months; only slab foundations allowed.
- Architectural & design controls: Exterior lighting must be consistent with dwelling style (no mercury lights). Mailboxes must be brick or masonry matching the house. Fencing allowed in rear/side yards: chain link or stockade, no barbed wire (except existing along rear lot lines), and no fences beyond the front building line. All utilities must be underground.
- Parking, vehicles & driveways: Driveways must be concrete, at least 20 ft long, with a culvert at least 18 inches in diameter. Garages must accommodate at least 2 cars. Recreational vehicles up to 35 ft long may be parked; disabled vehicles may be stored no more than 30 days unless in an enclosed garage. No driveway easements to adjacent properties are allowed.
- Sewage & drainage: If private sewage facilities (septic) are used, a permit and percolation test are required; only one residence per lot. Lot owners are responsible for septic maintenance. Houses on sloping lots must have finished floor elevation at least 12 inches above uphill grade. No building or filling in a floodway; houses in 100-year flood plain must have floor elevation at least 1 foot above flood level.
- Duration & enforcement: Covenants run for 35 years from October 1988, auto-renewing every 10 years unless modified by the Bessie A Easter Trust. Enforcement by the Trust or any lot owner via lawsuit. If any covenant is invalidated, the rest remain in effect.
