What Russell Addition's governing documents say
This is a set of recorded deed restrictions for Lot 1, Block 1 of Russell Addition in Johnson County, Texas. It governs how the lot can be developed, focusing on drainage, floodplain construction, and private sewage facilities. The restrictions bind current and future lot owners.
- Minimum building elevation: Houses on lots lower than the road must have a finished floor elevation at least 18 inches above the uphill-side yard grade to prevent storm drainage damage.
- Driveway culverts: Driveway culverts must be at least 18 inches in diameter (unless approved by the county commissioner or engineer) and sized for a 5-year storm. The driveway top must be 5 inches below the road edge to allow overflow.
- Floodplain & floodway restrictions: No house may be built in a 100-year floodplain unless the finished floor is at least 3 feet above the flood elevation shown on the plat. No building, fill, rocks, gravel, or other material is allowed in the floodway.
- Drainage easements: Blocking water flow or constructing improvements in drainage easements is prohibited. Existing creeks/channels must remain open and be maintained by adjacent lot owners. Johnson County has the right (but not duty) to clear obstructions.
- Private sewage facilities: If sewage is handled by a private system, performance cannot be guaranteed by the county. Owners must upgrade the system at their own expense if it causes odors, unsanitary conditions, or violates regulations. Owners are responsible for proper maintenance and compliance.
- What this document doesn't cover: This document does not create a homeowners association, common areas, assessments, leasing rules, pet restrictions, or architectural review. It covers only drainage, floodplain, and sewage restrictions applicable to this specific lot.
