- Document retention: The Association must permanently retain formation documents, bylaws, covenants, and amendments. - Payment plans for delinquent assessments: Owners can request a written payment plan (submitted to the managing agent or attorney) for delinquent regular/special assessments. - Contract bidding (over $50,000): For contracts exceeding $50,000, competitive bidding is required: at least three bids if qualified bidders exist. Exceptions for emergencies, warranty continuity, or lack of willing bidders. The Board may select a higher bid if justified, and conflicts of interest must be disclosed and managed.
- Covenant enforcement & fines: The Board may levy fines for violations of the Declaration, Bylaws, or Rules. Process: a courtesy notice (10 days to cure), then a notice of violation (certified mail) with hearing rights. Hearings must be within 30 days of request and follow Texas Property Code §209.007. Fines and suspension of common area use (up to 60 days per violation, longer for continuing) may be imposed. Repeated similar violations within 6 months may skip the initial notice.
