What Oak Tree Estates Homeowners's governing documents say
Oak Tree Estates is a single-family home subdivision in Arlington, TX, governed by restrictive covenants recorded in 1952. These covenants run with the land and place limits on how lots can be used and what homeowners can build or do. The rules apply to all lot owners and their successors.
- Land use (single-family only): Lots may be used only for residential purposes. Only one one-story, detached single-family dwelling and a private garage for up to two cars are allowed.
- Minimum lot and building size: Lots must be at least 55 feet wide at the building setback line and have a minimum area of 7,250 square feet. Dwellings must have at least 750 square feet of ground floor area (excluding open porches and garage).
- Setbacks and building location: Buildings must be set back at least 25 feet from the front lot line and 15 feet from side street lines. There must be at least 10 feet between dwellings on adjoining lots. No side yard is required for a garage located 50 feet or more behind the setback.
- Architectural control: No building, fence, or wall may be erected or altered without prior written approval of an architectural control committee. The committee reviews plans for quality, harmony of design, and location. Fences nearer to the street than the setback cannot exceed 5 feet in height. Approval is deemed given if the committee fails to act within 30 days.
- Nuisances and maintenance: No noxious or offensive activity is allowed. Trash must be kept in sanitary containers, and incinerators must be clean. No lot may be used as a dumping ground.
- Signs and temporary structures: Signs visible to the public are limited to one professional sign of one square foot and one sales/rental sign of up to five square feet. No temporary structures, trailers, tents, or outbuildings may be used as residences.
- Duration and enforcement: These covenants run for 25 years from recording (1952) and automatically extend for 10-year periods unless a majority of lot owners vote to change them. Enforcement is through legal action for violation or damages.
