What Alvarado Hills's governing documents say
Alvarado Hills (The Homesteads) is a single-family home subdivision in Johnson County, Texas, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) recorded in 1984. These rules apply to all lot owners in Phases I (Lots 1–51, Block 3 and Lots 1–20, Block 4). The document controls land use, architectural design, parking, pets, and maintenance, but does not establish an HOA or impose mandatory fees.
- Architectural review: No building, fence, wall, or landscaping may be started until plans are approved by the Architectural Control Committee (minimum 3 members). The committee must approve or reject submitted plans within 7 days; failure to respond within that time means approval is deemed given.
- Use restrictions: dwellings & setbacks: Lots are for residential use only. Each lot may have one detached single-family dwelling, or two adjoining lots may have one duplex. Dwellings cannot exceed two stories. Single-story homes must have at least 700 sq ft of ground floor (per side for duplex); multi-story homes need at least 500 sq ft of ground floor. Front yard setback is at least 25 feet; side setbacks 5 feet (10 feet from side street on corner lots).
- Pets: Pet allowances vary by lot. Lots 1–20, Block 4, and Lots 1–6 & 45–51, Block 3: maximum 2 domestic pets (not for commercial breeding). Lots 7–44, Block 3: maximum 1 'in house' pet not over 15 inches tall. No pet may create a nuisance by sight, smell, or noise.
- Parking & vehicles: No parking on streets or in yards (except circular driveways). Prohibited vehicles left on street or in park ditch over 3 days may be removed at owner's expense. Unlicensed or inoperable vehicles must be garaged or removed within 30 days. Repairs must be done inside a garage. No motorcycles, trucks, buses, RVs, or trailers may be parked on streets except during construction.
- Signs: Only one sign per lot, not over 5 square feet, advertising the property for sale or rent. The declarant and builders may maintain larger signs during construction and sales periods.
- Maintenance & nuisances: Owners must maintain their premises in neat and orderly condition. If not, the declarant or Architectural Control Committee may enter, repair, and charge the owner. Mobile/modular homes must be skirted within 60 days. Exteriors must be completed within 60 days of permit. Lots cannot be used as dumping grounds; garbage must be kept in sanitary containers.
- Easements & utilities: Easements for utilities and drainage are reserved as shown on the plat. The declarant may grant additional easements without compensation to owners. All structures must use City of Alvarado utilities. Shrubbery or fences interfering with easements may be removed without reimbursement.
- Enforcement & amendments: The declarant or any owner may enforce these restrictions. Failure to enforce does not waive future enforcement. The CC&Rs run for 20 years from recording (1984), then auto-extend every 10 years. Amendment during the first 20 years requires declarant approval if it owns 25%+ of lots; otherwise, 75% of lot owners must sign. After the first 20 years, amendments require 75% of lot owners during the last year of any 10-year period.
