What Three Rivers's governing documents say
Three Rivers is a commercial/industrial planned community in Avondale, AZ — you own a lot (undeveloped or with improvements) and are a member of the Three Rivers Owners' Association. The association maintains common areas (perimeter walls, landscaping, signage) and levies assessments on each lot. This document is the declaration of covenants, conditions, and restrictions that runs with the land.
- What you own & maintain: You own your lot and any improvements (buildings, parking, fencing). You are responsible for maintaining your lot and improvements in a condition consistent with first-class commercial construction in Avondale. Exterior painted surfaces must be repainted at least every 5 years.
- Assessments & fees: Each lot pays a monthly Common Expense Assessment (based on the association's budget), plus potentially a Special Assessment (if over 25% of the yearly budget, requires majority owner approval). During the period of Declarant control, owners also pay a Management Fee to the Declarant: $5,000/year total from all lots, with automatic CPI increases every 2 years but capped at $7,500/year until the 10th anniversary of the declaration's recordation. - Construction & sign guidelines: All improvements must comply with applicable zoning, design guidelines set by Declarant, and setback requirements. Roof appurtenances must be screened from neighboring lots. Monument signs require association and government approval; wall signs must be architecturally compatible with design guidelines.
- Enforcement & liens: If you violate any restriction, the Declarant or any owner can enter your lot to abate the violation and charge you for costs plus 10% administration fee, and may record a lien. The association's assessment lien is subordinate to first mortgages. If a lender forecloses, pre-foreclosure assessment liens are extinguished (but remain the personal obligation of the prior owner).
