What Ejr Ranch's governing documents say
This document is a water district membership covenant for EJR Ranch Phase II in Casa Grande, AZ, not a standard HOA rulebook. It binds all parcel owners in the subdivision to pay fees and assessments to the Central Arizona Groundwater Replenishment District (CAWCD) to secure an assured water supply for the property. Homeowners and buyers should understand this creates ongoing financial obligations and potential liens on their property.
- Water replenishment fees: Each parcel is subject to a Replenishment Assessment (annual), an Activation Fee, and a Replenishment Reserve Fee, all set by CAWCD. These fund groundwater replenishment and infrastructure.
- Payment before sale or lease: The Activation Fee and Replenishment Reserve Fee must be paid to CAWCD before the state real estate commissioner issues a public report authorizing the sale or lease of subdivided lands within the owner's portion of the property.
- Liens and personal obligation: Unpaid Replenishment Assessments, plus interest and penalties, become a lien on the parcel and a personal obligation of the owner who owned the parcel when the assessment came due. CAWCD has legal remedies to enforce payment.
- What this document doesn't cover: This covenant only addresses water district membership and related fees. It does not contain typical HOA rules about pets, rentals, architectural control, parking, or maintenance—those would be in separate governing documents.
