Mountainside Ranch is a single-family home subdivision in Chandler, AZ, governed by a homeowners association (HOA). The HOA maintains common areas and enforces rules to preserve property values. All lot owners automatically become HOA members. The rules apply to homeowners and their tenants.
- What you own & maintain: You own your lot and the house on it. The Association maintains the common areas (Tracts A and B), landscaping easements, and entry monuments. You are responsible for repairs resulting from your or your guests' negligence.
- Assessments & fees: The maximum annual assessment started at $480 per lot in the first year, with automatic annual increases of 5% or the CPI increase (whichever is greater). Special assessments require a vote of Declarant (while Class B membership exists) and two-thirds of Class A members. Late payments incur 12% annual interest and a 25% late fee (min $25). - Pets: Customary household pets (dogs, cats, birds) are allowed, but must not create a nuisance. The Board can determine if the number or type is reasonable. Animal waste must be promptly disposed of per local regulations.
- Architectural review: An Architectural Control Committee (ACC) must approve any construction, alteration, or installation (including sheds, antennas, solar collectors, satellite dishes). Minimum house size is 1,400 livable square feet (excluding garage, porches, etc.). No temporary structures or trailers as residences.
- Use restrictions: Lots are for residential use only. Home businesses are allowed if not detectable from outside, comply with zoning, and don't increase insurance or create nuisance. Only one 'For Sale' or 'For Rent' sign per lot (max 5 sq ft). Garages must be kept clean and doors closed except for access.
- Developer rights & annexation: The Declarant (Jeff Blandford Development Corp.) reserved the right to annex up to 59 additional lots within 7 years. Until then, Declarant holds Class B membership with 3 votes per lot owned, paying only 25% of assessments on undeveloped lots.
