This document is a Tract Declaration for Ocotillo East, a portion of the master-planned community Ocotillo in Chandler, AZ. It is an ancillary document that supplements the main Declaration of Covenants, Conditions, and Restrictions (CC&Rs) for Ocotillo. It primarily addresses land use classifications, design guidelines, and development requirements for the developer and original owners, not day‑to‑day rules for residents. Homeowners and buyers should refer to the main Declaration and any applicable supplemental guidelines for rules on pets, leasing, parking, etc.
- Land use classification: The Parcel (land within Ocotillo East) is designated for Multi‑Family Residential Use (Parcel B) or Single Family Residential Use (Phase I). No other uses are permitted without amendment.
- Design guidelines: In addition to the master Ocotillo Residential Guidelines, the Parcel is subject to specific 'Additional Design Guidelines' (e.g., Ocotillo East Additional Design Guidelines for Multi‑Family or Single Family Housing Product) covering roofing, patio covers, exterior colors, textures, product and site design, and landscaping. Copies are on file with the Design Review Committee.
- Development plan approval: No building permits or construction may begin until the Declarant (developer) has approved in writing the proposed uses, development plan, improvements density, plans and specifications, and any necessary easements. Approval is channeled through the Association and Design Review Board.
- Inundation easement: All portions of the Parcel lower than 1,190 feet above mean sea level are subject to an inundation easement for overflow from lakes, stormwater, or effluent. The Declarant, OELP, and Association are not liable for such overflow, and owners must indemnify them against claims from building below that elevation.
- Common area maintenance: The Owner of the Parcel must maintain all Common Areas within the Parcel (or areas controlled by the Association) according to Association standards, unless the Association undertakes that maintenance.
- Association membership and assessments: The Parcel is initially allocated a specific number of memberships (19 for Parcel B, 92 for Phase I). That number may be adjusted upon approval of a site plan or plat. Assessments and liens follow the master Declaration.
- Modification and term: The Tract Declaration may be amended by the Declarant for non‑material changes related to site plan approval or membership adjustments. Otherwise, amendments follow the master Declaration. The term is perpetual unless terminated under the master Declaration.
- What this document doesn't cover: This Tract Declaration does not contain typical homeowner rules such as pet restrictions, leasing limits, parking regulations, or noise/conduct standards. Those are governed by the master Declaration and any community‑specific rules. Residents should consult the full CC&Rs and any supplemental documents.
