What Water's Edge at Ocotillo's governing documents say
This is a Tract Declaration for Water's Edge at Ocotillo, a 16-acre parcel within the larger Ocotillo master-planned community in Chandler, AZ. It applies to the parcel (land) and its owners, not directly to individual homeowners, and primarily governs development, land use, and an effluent (reclaimed water) system. The parcel is designated for single-family residential use.
- Land use & development: The parcel can only be used for single-family residential development. Any building requires Declarant approval of plans, landscaping, and other easements. Further subdivision of the parcel is restricted and needs approval.
- Effluent obligation: The owner must accept, pay for, and dispose of a minimum 13,120 gallons of effluent per day (820 gal/acre). Charges include a fee for the minimum allocation plus possible charges for additional or excess effluent. The owner must maintain on-site effluent distribution infrastructure, and the association may step in if the owner fails.
- Inundation easement: All portions of the parcel below 1,190 feet elevation are subject to an easement for water and effluent overflow from the community's lakes. The association and Declarant have no liability for such overflow, and owners below that elevation must indemnify them against damage claims.
- Association membership & assessments: The parcel initially has 64 membership interests in the Ocotillo association. Upon subdivision, the number will be adjusted. Assessments and enforcement follow the master Declaration; this tract declaration does not set specific assessment amounts or rules.
- What this document doesn't cover: This is a partial document. It does not include typical homeowner rules such as pet restrictions, leasing limits, parking, architectural standards for individual homes, age restrictions, or maintenance obligations for homeowners.
