Brunswick Court Condominiums is a 2-unit condominium in Fountain Hills, AZ — you own your individual unit while the association maintains and insures the shared building structure and grounds, funded by equal per-unit assessments. The developer currently retains control of the board but will transfer governance to unit owners after 75% of units are conveyed or four years, whichever comes first.
- What you own & maintain: You own your unit's interior; the association maintains all common elements. Limited common elements (patios, balconies, utility meters) are allocated exclusively to each unit, and you are responsible for their maintenance and repair.
- Leasing & rentals: You may lease only your entire unit (not a partial lease), and the lease must be in writing with terms explicitly binding the tenant to all condominium governing documents. Lease violations by the tenant also constitute default under the lease itself. You must notify the association of lease start and end dates and the tenant's name.
- Pets: One household pet not exceeding 20 pounds is allowed per unit, and only unit owners may keep pets (not lessees or guests). Pets must be registered and inoculated; dogs must be leashed at 6 feet or less when outside the unit, and owners are responsible for immediate cleanup of droppings on common areas.
- Architectural review & alterations: Non-structural interior changes require no approval. Any structural alteration, any change visible from outside the building, solar panels, satellite dishes, utility lines, or window coverings require prior written Architectural Committee approval and (for structural work) certification from a licensed Arizona architect or engineer.
- Parking & vehicles: Vehicles must park in designated spaces only, except temporary parking for guests, delivery/service vehicles, or loading/unloading. No buses, vans, or trucks exceeding 3/4-ton capacity are allowed without Board approval. The Board may tow violating vehicles at the owner's sole expense.
- Use restrictions & nuisances: Units are for residential use by a single family only; no business or gainful occupation is permitted (though personal professional libraries and home-based personal business are allowed). Prohibited: clotheslines, exterior sound devices, inoperable vehicles, automotive repair, or nuisance activities visible from outside.
- Assessments & fees: Each unit is assessed an equal share of common expenses (budgeted 60+ days before each fiscal year) for maintenance, management, insurance, and reserves. Assessments have a maximum cap that may increase with the Consumer Price Index; increases beyond CPI require a two-thirds member vote.
- Board governance & control: During the initial Period of Declarant Control (ending when 75% of units are conveyed or 4 years after sales cease—whichever is earlier), the developer appoints the Board. Thereafter, unit owners elect the Board, which must include at least one unit owner.
