Brunswick Heights Condominiums is a 2-unit condominium community in Fountain Hills, AZ. You own your unit (including the garage) and an undivided 50% interest in common elements. The association handles common area maintenance and insurance; you maintain your unit and assigned limited common elements like patios, backyards, and the roof above your unit.
- What you own & maintain: Your unit includes interior finished surfaces and the garage. Limited common elements assigned exclusively to you include the covered patio, backyard, any utility meter serving only your unit, and exterior doors/windows. You must maintain your unit, patio/balcony concrete and paint, garage door and opener, HVAC equipment, water heater, and the roof above your unit. The association maintains all common elements and structural parts of limited common elements.
- Assessments & voting: Annual and special assessments are split equally between the two units (50% each). Special assessments require 100% approval of votes present at a meeting. Assessments are due in installments set by the board (monthly to semiannually). Delinquent assessments accrue 10% interest and late fees, and the association has a lien on the unit.
- Use restrictions: No dumping or visible trash. Common elements and limited common elements cannot be used for storage (except patio furniture in rear limited common element). No visible storage of boats, RVs, trailers, or vehicles in disuse for more than 72 hours in 30 days. No exterior speakers (except security). No clotheslines visible from outside. No nuisance or unlawful activity.
- Parking & vehicles: Routine overnight parking of daily-use vehicles is allowed. Boats, RVs, trailers, and other vehicles not in daily use may not be stored in driveways for over 72 hours in any 30-day period.
- Maintenance & alterations: You must maintain your unit and limited common elements. Exterior color changes or painting of patios/balconies require board approval. If you fail to maintain after 30 days' notice, the association may do the work and charge you. Damage to common elements caused by you or your guests is your liability.
- Insurance: The association carries property insurance on common elements and liability insurance. You should obtain your own insurance for your unit and personal property. Insurance proceeds for common element losses are held by the association for unit owners and lienholders.
- Dispute resolution: Any dispute must first go to mediation in Maricopa County, Arizona, then to binding arbitration if unresolved. Each party pays its own costs and shares joint expenses equally, though the arbitrator may shift costs to the losing party.
