Both unit owners must approve structural changes and exterior modifications to each other's units, and the association maintains common elements, funded by equal per-unit assessments.
- What you own & maintain: You own your unit's interior (bounded by exterior wall surfaces, roof, and ceiling). You're responsible for your allocated limited common elements (yard, patio, and individual gas/electric meters); the association maintains all other common areas.
- Single-family residential use: Your unit must be used exclusively for residential occupancy by a single family. No business operations, trade, or gainful occupation is allowed, though you may maintain a personal professional library, keep business records, and handle personal business calls or correspondence in your unit.
- Architectural controls & approval: Non-structural improvements to your unit interior don't need approval, but any structural additions, alterations, or changes to exterior color or texture require written approval from your adjacent unit owner. The community is also subject to the Fountain Hills Committee of Architecture; if rules conflict, the more restrictive rule governs.

- Parking & vehicle restrictions: No automobiles, motorcycles, or other motor vehicles may be constructed, reconstructed, serviced, or repaired on the property in a manner visible from neighboring property, except for emergency repairs. No inoperable vehicles may be stored or parked visibly from neighboring property.
- Prohibited activities: Outside clotheslines and clothes-drying facilities are prohibited. Solar panels, satellite dishes, antennas, telescopes, and radio/television signal collectors visible from neighboring property require written consent from your adjacent unit owner. Exterior speakers, horns, whistles, and bells are prohibited except for security or emergency purposes.
