This is the Declaration of Condominium for Desert Jewel Condominiums, a two-unit condominium project in Fountain Hills, AZ. You own your unit (interior spaces) and an undivided one-half interest in the common elements. The association maintains common elements; you maintain your unit and assigned limited common elements (e.g., patio, entryway). Use restrictions and parking rules apply to both units and common areas.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings, fixtures) and must maintain it, including interior surfaces, plumbing, electrical, and HVAC. The association maintains common elements (exterior walls, roof, landscaping, common areas). Limited common elements like driveways, patios, and porches are your responsibility.
- Assessments & fees: Annual assessments are set by the board based on a budget and shared equally between the two units (one-half each). Special assessments require approval of two-thirds of votes cast at a member meeting. Delinquent assessments accrue interest at 12% per year (or VA loan rate) and late fees, and the association has a lien superior to all but first mortgages.
- Parking & vehicles: Driveways are limited common elements for daily parking. No vehicle may be stored in a driveway for more than 72 hours in any 30-day period. Boats, RVs, trailers, and other vehicles must not be visible from the street or stored on common elements.
- Use restrictions: No dumping, storage of furniture or chattel on common elements (except patio furniture in use). No exterior fires except barbecues in approved containers. Owners are liable for damage caused by themselves or guests.
- Damage & insurance: The association carries master insurance for common elements. If a unit is damaged, the owner must rebuild in substantial compliance with original plans or with board approval. Insurance proceeds for common elements are held by a trustee. Any deficiency from insurance can be covered by a special assessment.
- Enforcement & amendments: The association, any owner, or the town may enforce restrictions via legal action and recover attorney fees. The declaration may be amended by unanimous board vote with city approval. Failure to enforce does not waive future enforcement.
