What Jackalope Condominiums's governing documents say
Jackalope Condominiums is a small condominium community in Fountain Hills, AZ, with only two units (Unit A and Unit B) in a single building. You own your unit individually and share a 1/2 undivided interest in the common elements (landscaping, roadways, etc.), which the association maintains and insures. This declaration sets the rules for use, maintenance, assessments, and restrictions that apply to all owners, occupants, and tenants.
- What you own & maintain: You own the interior of your unit (including non-structural interior finishes, hot water heater, AC, garage) and are responsible for its maintenance and repairs. You also maintain the limited common elements assigned to your unit (e.g., adjacent driveway, patio, exterior doors/windows). The association maintains and insures all common elements (shared structure, landscaping, etc.) as a common expense.
- Assessments & fees: Regular assessments are set equally for each unit (no per-square-foot formula) and paid monthly. Special assessments may be levied for capital improvements or to cover an owner's non-compliance. Assessments are due on the 1st of the month; a late charge applies after 15 days, and 6% interest accrues after 30 days. Unpaid assessments become a lien on the unit and can be foreclosed.
- Leasing & rentals: You may lease your unit, but any lease must be in writing and must include a provision that the tenant's failure to comply with the declaration or association rules is a lease default. There is no minimum lease term stated in this declaration (the earlier Maplewood excerpt had six months; this one does not). As the owner, you are responsible for your tenant's compliance.
- Pets: Up to two household pets (dogs, cats, etc.) are allowed per unit, provided they are not kept for commercial purposes. The total weight of all pets in a unit may not exceed 75 pounds without approval from the members (both owners). Pets must be leashed on common elements, and owners must clean up waste.
- Parking & vehicles: Parking on common elements is prohibited except for temporary loading/unloading by invitees or service vehicles. All vehicles (including motorcycles, boats, RVs, trailers) must be parked inside your unit's attached garage. Commercial trucks, mobile homes, and campers are not allowed anywhere on the property except inside the garage or with member approval. Garage doors must be kept closed when not in use, and garages may not be converted to living space.
- Exterior alterations & signs: No structural alterations or exterior changes (including solar panels, awnings, fences, landscaping changes) may be made without prior written approval of both unit owners. Non-structural interior changes are allowed without approval but you are liable for any damage to other units or common elements. Window coverings visible from outside must be neutral colors. Signs are limited to small name/address signs and political signs allowed by law; no for-sale or for-rent signs on the property without consent.
- Insurance & disaster: The association carries a master casualty insurance policy covering the building, common elements, and each unit (exclusive of personal property) at 100% replacement cost, plus liability insurance of at least $1,000,000 per occurrence. You should obtain your own insurance for your personal property and any alterations you make. Insurance proceeds are held by the association and used for repair or reconstruction unless the condominium is terminated.
- Use restrictions: Units are for private residential use only; no business, professional, or commercial activity is allowed without the consent of all owners. Nuisances, offensive activities, and illegal acts are prohibited. No waterbeds are allowed on second floors. No external laundering or clotheslines. No repairs of vehicles or machinery on the property. The condominium is subject to the master declaration of the larger Fountain Hills community.
