Eagle Mountain Parcel 4 is a single-family residential tract within the Eagle Mountain master-planned community in Fountain Hills, AZ. This document is a tract-specific amendment (recorded 1998) that sets design, landscaping, and assessment rules for the subdivision but does not stand alone — it references and incorporates the broader Eagle Mountain master HOA declaration recorded in 1995.
- Community structure: This is a sub-tract (Parcel 4) within the master Eagle Mountain planned community. Lot owners hold memberships that determine voting rights and assessment responsibility. The tract cannot be further subdivided without developer and board consent.
- Minimum home size & design approval: Each home must contain at least 2,500 square feet of liveable space (excluding garage or guest house). All dwellings and improvements require prior written approval from the Residential Design Review Committee and must comply with Eagle Mountain and Parcel 4 design guidelines.
- Landscaping requirements: All owners must complete front-yard and street-visible landscaping (including irrigation) within 3 months of occupancy, unless they obtain a written variance. The association can install landscaping at owner expense if the owner does not comply.
- Golf course lot tree requirements: Owners of Lots 1–9 (except the developer) must plant a minimum of 2 trees per 100 feet of golf course frontage in the rear yard, with trees at least 24" in box size and at least one within 25 feet of the 12th tee. Installation must be completed within 3 months of occupancy, or the association may install at owner expense.
- Assessments & developer subsidy: The tract is subject to assessments for Special Service Area A (shared amenities across multiple parcels including private gates) and the Parcel 4 Special Service Area (local improvements). The developer will subsidize the difference between actual operating costs and assessment revenue until 600 memberships are assigned; after that point, assessments must cover full costs.
- Construction period & gate access: Construction activity is expected to continue until homes are built on all lots. During construction, any entrance gate may remain open during daylight hours for construction access. The developer made no warranty that a gate will be installed.
