Milo Condominiums is a small condominium community in Fountain Hills, AZ with just two units (A and B). This governing document applies to everyone who owns a unit—you own the interior of your unit and share ownership of the building's common elements, which the association maintains. The association is run by a board elected after the developer's control period ends. This document is the full rulebook for the community.
- Leasing & rentals: Leasing is completely prohibited—no unit owner may lease their unit. This applies to all owners, not just a minimum term.
- Pets: No more than one household pet per unit, and the pet must weigh 20 pounds or less. Pets are only allowed for unit owners—lessees and invitees may not bring pets.
- Use & occupancy: Units may only be used as a single-family residence by occupants related by blood, marriage, or adoption, or an unrelated group maintaining a common household. No business or commercial use is allowed.
- Architectural review: Any structural changes or exterior alterations (including window coverings, antennas, or anything visible from outside) require prior written approval from the Architectural Committee. Nonstructural interior changes do not need approval.
- Parking & vehicles: Parking is limited to designated spaces. Buses, trucks over 3/4 ton, and commercial vehicles are prohibited without board approval. No inoperable vehicles or repairs visible from neighboring property.
- Assessments & fees: Each unit pays equal (50%) common expense assessments. The initial maximum annual assessment per unit was $125, adjustable by CPI increases or a 2/3 vote. Special assessments require 2/3 approval. Late fees and interest apply on delinquencies.
- Insurance: The association carries property insurance on common elements and units (excluding owner improvements), general liability (minimum $1 million), directors & officers liability, and fidelity bonds. Unit owners may buy separate coverage for their unit and belongings.
