Segundo Condominiums is a two-unit condominium in Fountain Hills, AZ. You own your individual unit and share the common elements equally with your single adjoining neighbor. The community is governed by this full declaration, which sets strict use restrictions, joint maintenance duties, and a requirement for neighbor approval on exterior changes.
- Use & occupancy: Units are limited to single-family residential use only. No home business, gainful occupation, or nonresidential use is allowed (though you may keep a personal professional library or handle business calls). Nuisances and offensive activities are prohibited.
- Exterior changes & approvals: Structural additions or alterations, as well as changes to exterior color or texture, require prior written approval of the adjoining unit owner. Solar collectors, satellite dishes, or similar devices visible from neighboring property also need neighbor consent. An Architectural Committee may adopt additional rules.
- Maintenance responsibilities: Each unit owner maintains their own unit and Limited Common Elements (yard, patio, exterior doors/windows). The Association maintains Common Elements, but if it fails to do so, each owner must maintain the half of Common Elements contiguous to their unit. Owners are liable for damage they cause to the other unit or Common Elements.
- Vehicles & trash: No inoperable vehicles may be parked or stored so as to be visible from neighboring property. Except for emergency repairs, no vehicle construction or servicing is allowed if visible. Trash must be kept in covered containers approved by the town. Outside clotheslines are prohibited.
- Insurance: Each unit owner must maintain fire, casualty, and liability insurance on their unit covering full replacement value, with at least $500,000 in combined liability coverage. Proof of insurance must be provided to the adjoining unit owner.
- Dispute resolution: Disputes between unit owners must first be resolved through a 21-day notice period. If unresolved, the matter is submitted to binding arbitration through the American Arbitration Association, with a 30-day compliance period after the decision.
