Aguila Del Sol is a single-family home subdivision in Glendale, AZ, governed by recorded Covenants, Conditions & Restrictions (CC&Rs) that run with the land and bind all lot owners. It is part of the Arrowhead Ranch Phase III master-planned community, and the restrictions here are subordinate to that master declaration.
- Minimum home size & construction standards: Each single-family dwelling must have at least 2,000 square feet of enclosed living area floor space (excluding porches, garages, carports, servants quarters). Buildings must be constructed of brick, cement block, or other substantial masonry, or insulated frame. All construction must use new first-class materials; exterior surfaces must be finished or natural.
- Architectural review & approval: No building, fence, wall, or other structure may be commenced without prior written approval of the Architectural Control Committee (ACC). The ACC may refuse plans for aesthetic or any other reason. Subsequent additions or alterations also require ACC approval. The ACC initially consists of three members designated by the Declarant; after 90% of lots are sold, two members are chosen from lot owners and one by Declarant.
- Landscaping & maintenance: Landscaping must be approved by the ACC and completed within three months of house completion, with a minimum market value of approximately $1,750 (based on 1984 values). Lots must be kept free of rubbish and weeds; yards must be neat. If a lot owner fails to maintain, any four lot owners may arrange cleanup and file a lien for costs.
- Building setbacks & height limits: Front walls must be at least 25 feet from the front property line, side walls at least 10 feet (unless shown otherwise on plat), and rear walls at least 25 feet from the rear property line. No solid wall, fence, or hedge over 3 feet in height is allowed nearer the front street than the front wall. Side or rear fences/walls may not exceed 6 feet.
- Vehicles & parking: No trucks, trailers, boats, campers, or similar vehicles (other than passenger automobiles) are permitted on any lot without prior written ACC approval for screening. No vehicle may be used for living quarters. Car repair work is prohibited; no inoperative vehicles or junk may remain. Garages are limited to 3 cars; only vehicles actively used by owners may be stored.
- Pets & animals: No animals, fish, or birds may be raised, bred, or kept for commercial purposes. Up to two dogs and/or two cats may be kept as household pets. Dogs must be on a leash when not confined to the lot.
