Arrowhead Ranch Phase II is a master-planned community in Phoenix, AZ, consisting of single-family homes governed by a Master Declaration and supplemental Subsidiary Declarations. The documents here are legal filings that add specific restrictions for certain tracts (e.g., lakefront lots) and amend the master rules. Homeowners are bound by both the Master Declaration and any Subsidiary Declarations covering their lot.
- What this document covers: These are a Subsidiary Declaration (imposing extra restrictions on 170 lots in Arrowhead Ranch Area Twelve) and two amendments to the Master Declaration. They are not the complete rulebook; the Master Declaration still governs general matters like assessments and architectural control.
- Subdivision & lot restrictions: No lot may be further subdivided, rezoned, or have its boundaries changed without the Master Board's written approval. No additional covenants or easements may be recorded without Master Board consent.
- Lakefront property (Tract A & B Lots): Lots in Tract A (138–170) and Tract B (22–44) have a 10-foot lakefront easement reserved to the Declarant for lake, shoreline, sprinkler, and landscaping. Owners may not place anything in that easement without Declarant's permission. A 6-foot masonry/wrought iron fence (no gates) must be built along the rear lot line at occupancy, and owners must maintain it. Emergency access only to Tracts A and B.
- Water rights: All water on the property is reserved to the Declarant (Paloma Corporation) and its successors. Owners have no right to use or consume that water.
- Assessment liability transfer (amendment): The First Amendment changed the Master Declaration so that a lot owner's personal obligation for annual, special, and utility assessments does not pass to a new owner unless expressly assumed. However, the prior owner remains liable for assessments due before transfer.
- Voting & amendment thresholds (amendment): Class B voting membership (developer) converts to Class A when Class A votes meet or exceed Class B votes, or 15 years after the Master Declaration, whichever comes first. Amendments now require 75% of all lot owners' affirmative vote (instead of 2/3 of votes cast).
- Developer right to add land (amendment): The Declarant's right to add additional land to the community expires 15 years after the Master Declaration was recorded (August 15, 1984).
- What this document doesn't cover: These documents do not state specific rules on leasing, pets, parking, or architectural standards. Those would be found in the Master Declaration or other community rules.
