Hamilton Arrowhead Ranch is a single‑family home HOA in Glendale, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) binds all lot owners and defines property rights, maintenance duties, architectural controls, and use restrictions.
- What you own & maintain: You own your lot and all improvements (house, landscaping). You are responsible for interior and exterior upkeep, including landscaping. The association maintains the common areas (lakes, guardhouse, entry landscaping, parkways) funded by assessments.
- Use restrictions: Lots are for single‑family residential use only. Minimum floor area is 2,000 square feet (excluding garage and porches). No business, hospital, or other commercial uses. No oil drilling. Roofs must be clay or concrete tile unless approved.
- Pets: Dogs, cats and other household pets are allowed but not for commercial breeding. Pets must be kept in a fenced yard or on a leash. No cows, sheep, goats, poultry, or horses.
- Architectural review: All construction, alterations, painting, landscaping, fences, and even satellite dishes must be approved in writing by the Architectural Committee. Plans are deemed approved if the committee does not disapprove within 30 days.
- Assessments & fees: Annual assessments are set by the board and paid in monthly installments. Special assessments cannot exceed 20% of the annual budget without a member vote. Delinquent assessments accrue interest (max 18% per year) and become a lien on the lot.
- Parking & vehicles: Vehicles must be parked in the garage or driveway. No vehicle may remain in a driveway for more than one week without being moved or garaged. No boats, trailers, campers, or inoperable vehicles may be stored on the lot.
- Construction timeline: Construction must start within 12 months of lot purchase and be completed within 24 months. Landscaping must be finished within 120 days after certificate of occupancy. If these deadlines are missed, the Declarant (builder) has an option to repurchase the lot.
- Declarant's special rights: The Declarant (builder) is exempt from assessments until lots are sold, and holds 110 votes per lot until 1995 or until all lots are sold, giving it control over the board during development.
