What Patrick Ranch's governing documents say
Patrick Ranch is a single-family subdivision in Glendale, Arizona — you own your individual lot and house outright (not as a condo). The community is governed by a homeowners association funded by per-lot assessments and enforced through architectural review, use restrictions, and maintenance obligations that run with the land.
- What you own & maintain: You own your lot and detached house. You're responsible for maintaining the dwelling unit, all utilities, plumbing, electrical, roofs, windows, doors, paint, and siding. The association does NOT maintain common areas (there are none).
- Assessments & fees: Initial annual assessment is $72 per lot (capped through 1994). After 1994, assessments can increase annually by the greater of 10% or the Consumer Price Index, unless members vote (2/3 approval required) for a larger increase. Late payments incur a $50 one-time fee plus 10% annual interest.
- Landscaping requirements: You must landscape your front/public yard within 90 days of purchase, with plans approved by the Architectural Committee. You must maintain all landscaping in clean, neat condition and remove trash and weeds — this is your ongoing responsibility.
- Architectural review: The Architectural Committee approves most alterations and improvements. Fences and walls are limited to 6 feet in height. Plans for landscaping, windows, roofs, antennas, and other visible improvements require pre-approval.
- Use restrictions: Only single-family residential use is allowed — no business, commercial activities, signs, or commercial/recreational vehicles. Commercial vehicle repair is prohibited. Hazardous waste storage, fuel tanks, and outdoor burning are restricted.
- Assessment liens & enforcement: Unpaid assessments create a lien on your lot. The association can foreclose like a mortgage lender. The assessment lien is senior to later liens (including second mortgages) but subordinate to first mortgages and property taxes.
- Developer control period: Beazer Homes (the developer) holds enhanced voting rights (Class B: 3 votes per lot vs. 1 for owners) for approximately 6 years from the first lot sale, or until owner-held lots outvote developer lots. Control then transfers to the membership.
