What Tuscany Ranch's governing documents say
Tuscany Ranch is a standard single-family home HOA in Glendale, AZ — you own your lot and home, and the association maintains common areas and enforces rules to protect property values. This document is the full set of Covenants, Conditions & Restrictions (CC&Rs) that bind all owners.
- What you own & maintain: You own your lot and house; the association maintains common areas, landscaping on common areas, and has the right to repair your exterior if you don't (after 30 days' notice). Homes must be at least 3,500 sq ft livable space with a private garage for at least 3 cars.
- Leasing & rentals: Leases must be for at least 30 consecutive days and require association consent. No short-term rentals or vacation rentals. Only the entire lot (with house) may be rented, and only to a single family.
- Pets: You may keep up to 3 dogs (reasonable size at board's discretion), 2 cats, and other small indoor pets. No commercial breeding. American Pit Bull Terriers and all pit bull breeds are prohibited. Dogs must be kept in a fenced area or otherwise controlled.
- Architectural review: Any exterior alteration, improvement, fence, wall, or change in color scheme requires prior written approval from the Architectural Committee. The committee has 60 days to approve or disapprove; if no decision, approval is deemed given. Landscaping (front, side, back) must be completed within 3–12 months of final building inspection and meet specified requirements (e.g., 15% grass, 4 36" box trees, etc.).
- Parking & vehicles: Recreational vehicles, boats, trailers, campers, and trucks must be garaged. No parking on common areas without board approval. Vehicles in uncovered parking must be in operating condition. No major repairs visible from neighboring property for more than 24 consecutive hours.
- Assessments & fees: Annual assessments are set by the board, initially capped at $2,000 per year (until Jan 1, 2007) and cannot increase more than 20% per year without member approval. Special assessments require 2/3 member vote. Delinquent assessments accrue interest at 12% per year and can result in liens and suspension of voting rights and common area use.
- Use restrictions & businesses: Lots are for single-family residential use only. Home businesses are allowed only if not visible or detectable from outside, conform to zoning, and don't create nuisance. No signs visible from neighboring property without architectural approval (except political signs up to 24"x24" displayed 45 days before election and removed 7 days after).
- What this document doesn't cover: This document does not specify certain modern issues like short-term rental platforms (e.g., Airbnb), solar panel regulations beyond requiring approval, or specific trash collection services (board may require subscription). It also does not detail amenities or common facilities beyond referencing common areas.
