This is a Declaration of Covenants, Conditions and Restrictions for Cielo Grande, a single-family home community in Peoria, AZ. It establishes an HOA that maintains private streets, a gate, and landscaped areas, and binds all owners and residents. The community is designed for high-end custom homes with strict architectural standards, and rental of homes is prohibited.
- Architectural standards: Homes must be at least 4,500 livable square feet, of French Provincial or traditional style, with roofs of flat concrete or tile pitched 8:12 or greater. Attached 3-car garages required. Modular homes, trailers, campers (as residences), carports, prefabricated structures, and shingle/wood shake roofs are prohibited.
- Leasing & rentals: No owner may lease or rent their parcel or residence (Section 5.13).
- Home business: Business activities inside a home are allowed only if not detectable from outdoors, generate no extra traffic/parking, use no non-customary hazardous materials, and comply with zoning; no customers come to the home, and only residents may work there.
- Vehicles & parking: Vehicles must be parked in the garage if possible; otherwise on driveway. No vehicles over 8' high or 24' long (except temporary contractor/guest vehicles) may be visible from neighboring property. No overnight parking on common areas, no storage on streets, no inoperable vehicles visible, and no commercial vehicles stored visibly.
- Assessments & fees: Annual regular assessments are levied equally per parcel, due January 1; a transfer fee of 1/6th of the then-current regular assessment is paid by each purchaser at close of escrow. Special assessments require a Super Majority (3 owners plus Declarant) and Declarant's approval while Declarant owns a parcel.
- Signs: Only allowed: one temporary 'For Sale'/'For Rent' sign up to 5 sq ft, one residential identification sign up to 400 sq in, signs required by law, and Declarant's/contractor's sales signs.
- Pets: The document does not address pet restrictions.
