Glendale Airport Hangar India Association is a non-residential condominium-like community for aircraft hangars at Glendale Municipal Airport in Glendale, AZ. Owners hold a possessory interest in a hangar unit and share common areas (ramps, office/restroom facilities) subject to a master ground lease with the City of Glendale that expires January 27, 2036. This document binds all owners and occupants to airport rules, FAA regulations, and association rules, and prohibits residential use, animals, and certain exterior alterations.
- What you own & maintain: You own the interior of your hangar unit (walls, doors, main hangar door, electric opener, and any owner-installed improvements). The association maintains the common areas (roof, exterior walls, power transformers) and pays a proportionate share of the master ground lease and shared facility costs (office, restrooms, internet). Paved taxiways and ramps on either side of the hangar row are maintained by the City of Glendale.
- Permitted uses & restrictions: Hangar units may only be used for aircraft storage and operations; no residential occupancy (temporary or permanent) and no animals are allowed. All use must comply with City of Glendale Airport Minimum Operating Standards, Rules and Regulations, and FAA rules. Negligent operation, interference with utilities, and nuisances (odors, sound devices) are prohibited.
- Insurance requirements: Each owner must maintain aircraft liability insurance of at least $1,000,000 combined single limit per occurrence, naming the City of Glendale as an additional insured, with 30 days' written notice before modification or termination. The association carries general liability insurance and fidelity bonds, but does not insure the contents of hangar units.
- Architectural review: There is no permanent architectural committee; the board of directors handles all architectural decisions until members vote to create a committee. Exterior antennas, signs, air conditioning/heating units, and any utility lines require board approval. No roof penetration or exterior alterations without approval.
- Assessments & fees: Annual assessments are set by the board and may be increased or decreased; special assessments may be levied for unanticipated expenses. Assessments are collected monthly, quarterly, or annually and cover ground lease payments, insurance, maintenance, utilities, and management fees. Nonpayment results in a lien with 12% annual interest and foreclosure rights, plus 18% interest on judgments.
- Leasing & rentals: Owners may lease their hangar unit, but lessees must comply with the declaration and airport rules. The declaration does not set a minimum lease term. Any delegation of use to tenants or guests must comply with board rules.
- Compliance & enforcement: Violations of the declaration, airport rules, or FAA regulations are grounds for enforcement. The board may enter a hangar unit (with 24-hour notice, or immediately in an emergency) to remedy a breach, and may disconnect utilities or padlock the unit. Remedies include injunction, abatement as a nuisance, and self-help. The city of Glendale also has enforcement rights.
- Property rights & ownership: Ownership is a possessory interest under a master ground lease from the City of Glendale. The declaration automatically terminates when the master lease ends, unless the city elects to keep it in effect. Owners have an easement to use common areas, which cannot be sold separately.
