Sun Country Estates is a single-family home homeowners association (HOA) in Komatke, AZ. This document is the Association's Bylaws—it governs how the HOA is run (board elections, meetings, budgets, discipline procedures) but does NOT contain the everyday rules for homeowners (those are in the Declaration of Covenants, Conditions & Restrictions, or CC&Rs).
- Membership & Meetings: Each lot owner automatically becomes a member with one vote per lot. Annual meetings are required; special meetings can be called by the president, board majority, or by 10% of members. A quorum is 10% of votes entitled to be cast. Proxies are allowed and expire after 25 months.
- Board of Directors: The board has 3 to 5 directors elected by members. Terms are staggered once Class B membership ends: 3-year, 2-year, and 1-year terms. Directors can be removed by majority vote of members. Vacancies are filled by remaining directors.
- Assessments & Budgets: The board levies regular and special assessments as described in the Declaration. A budget must be distributed at least 30 days before the fiscal year. The board can adopt budgets without member consent but must provide a summary within 30 days.
- Discipline & Penalties: The board can suspend voting rights or common area use for up to 60 days per violation (except for nonpayment of assessments, which has no time limit). Monetary penalties require a pre-approved schedule and a hearing. The board cannot forfeit a lot owner's right to their lot except by court order or foreclosure.
- Records & Inspections: Members, first mortgagees, and insurers can inspect the membership register, financial statements, minutes, and the Declaration at reasonable times with 48 hours' notice. Directors have an absolute right to inspect all records and properties.
