All owners are automatically members and must pay annual and special assessments. The declaration establishes rules for property use, architectural control, maintenance, and other restrictions that apply to all lots and residents.
- Architectural review: Any exterior improvement, alteration, or change in landscaping requires prior written approval from the Architectural Committee. Applications are deemed disapproved if not answered within 45 days. The committee may charge a review fee and enforce design guidelines.
- Use restrictions & home businesses: All lots must be used exclusively for residential purposes. - Signs: Signs visible from neighboring property are generally prohibited except for: residence identification signs (with architectural approval), temporary 'for sale' signs (max 120 days per 365-day period), and temporary 'open house' signs (10 a.m. to 6 p.m.).
- Assessments & liens: Each lot is subject to annual assessments (set annually by the board, subject to a maximum) and special assessments approved by members. Unpaid assessments become a lien on the lot, and the association may collect late fees, interest, and attorney's fees.
- Maintenance responsibilities: Owners must maintain their lot, including landscaping, and keep the property in good repair. The association maintains common areas. Owners are responsible for maintenance of landscaping in public rights-of-way adjacent to their lot unless the association has assumed responsibility.
