Sterling Pointe Condominium is a 4-unit condominium community in Phoenix, Arizona. You own your unit and a 1/4 undivided interest in the common elements; the association maintains common areas and enforces rules. This declaration governs all unit owners and residents.
- Residential use & home businesses: All units are for residential use only. A limited home business is allowed if it is not detectable from outside the unit, complies with zoning, and does not involve customer visits or door-to-door solicitation.
- Architectural review: Any exterior construction or modification (including changes to landscaping, paint, or structures) requires prior written approval from the Board of Directors. The board has 45 days to respond; if no response, approval is deemed granted. Decisions may be based on aesthetic considerations.
- Pets: No more than two 'Permitted Pets' (domestic dog, cat, bird, or other animal approved by the board) per unit. Dogs must be leashed outside the unit, and owners must clean up feces. Pets must not cause noise, odor, or nuisance.
- Parking & vehicles: Trucks, trailers, campers, boats, and similar vehicles may not be parked anywhere in the condominium. Each unit has two assigned parking spaces (Limited Common Elements); owners must park only in their assigned spaces. Inoperable vehicles must be stored in a garage.
- Leasing & rentals: Units may be leased only in their entirety (no partial rentals). Leases must be in writing and include a provision that the lease is subject to the condominium documents. No subleasing allowed. Owners must provide the association with lease start/end dates, tenant names, and emergency contact at least 10 days before occupancy.
- Maintenance responsibilities: The association maintains all common elements (including exterior walls and common infrastructure). Unit owners are responsible for maintaining their own unit and certain limited common elements, such as fenced yards and utility lines serving only their unit. If an owner fails to maintain, the association may do so and charge the owner.
- Assessments: Each unit pays an equal share of common expenses (1/4 each). The board can levy regular assessments and special assessments. Nonpayment creates a lien on the unit.
