What Litchfield Heights's governing documents say
Litchfield Heights is a single-family residential community governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs). The rules apply to all lot owners and residents, covering architectural standards, land use, and property maintenance. This document establishes a homeowners' association framework and runs with the land, binding current and future owners.
- Residential use & business restrictions: Lots may be used only for single-family residential purposes. Businesses are allowed inside a residence only if not detectable from outside, do not involve customer visits or solicitation, and comply with zoning. Leasing a home is not considered a business.
- Architectural review: An Architectural Committee must approve all exterior improvements, including construction, alterations, and changes to the exterior appearance. The committee has 30 days to act after receiving a complete application; if no decision is made, approval is deemed granted. In-ground swimming pools in back or side yards do not require approval if not visible from neighboring property; above-ground pools require approval.
- Leasing & rentals: Leases must be for at least 30 days; transient or hotel use (less than 30 days) is prohibited. Each lease must require the tenant to comply with the CC&Rs, and the owner is responsible for tenant compliance.
- Minimum home size: Every residence must have at least 1,500 net livable square feet (excluding garages, covered patios, and balconies).
- Pets & animals: Up to two domestic pets (dogs, cats, or household birds) may be kept without approval. Additional pets and other animals (horses, livestock, poultry) require Architectural Committee approval. Horses are limited to one per 10,000 sq ft of lot area, with a maximum of four per lot. Swine are prohibited except Vietnamese potbellied pigs. All animals must be confined to the owner's lot and not create a nuisance.
- Parking & vehicles: No commercial vehicles, RVs, boats, or trailers may be parked visible from neighboring property except: temporary parking for loading/unloading (max 24 consecutive hours, 48 hours per week), a car/truck under 7 ft tall and 20 ft long on a concrete driveway, and guest parking on streets for up to 12 hours. Vehicle repairs are allowed only for emergencies or inside a closed garage. Garages must be used primarily for parking and must accommodate at least one car.
- Outdoor standards & nuisances: No temporary structures (including mobile homes, RVs, tents) may be used as residences. Clotheslines, antennas (unless approved), and roof-mounted HVAC units visible from neighbors are restricted. A Natural Area Open Space (NAOS) must be preserved at the front of each lot, maintaining native plants. Fencing within 10 ft of property lines must be three-rail galvanized pipe, with a minimum 50-ft setback from front street lines.
- Term & amendments: The CC&Rs last for 35 years from recording (1999) and automatically renew for successive 10-year periods. Termination requires a 75% vote of owners. Amendments also require 75% owner approval, plus Declarant consent while Declarant owns any lot.
