Wigwam Creek is a commercial development in Litchfield Park, AZ. This supplemental declaration imposes additional use and design restrictions on a specific parcel (Lot 9) owned by King Ranch Properties, which must initially be developed for high-density multifamily residential. It is not a full set of rules for homeowners or tenants; it primarily governs the relationship between the developer (SunCor) and the parcel owner.
- Use restriction: The Owner’s Parcel (Lot 9) must be used initially for high-density multifamily residential. The use cannot violate the master declaration or any exclusive use restrictions in Exhibit C.
- Design & plan approval: SunCor must review and reasonably approve all improvement plans, including site paving, grading, landscaping, lighting, signage, building elevations, and utility plans, before submission to the city.
- Pre-construction maintenance: The parcel owner must keep the lot clean and free of dust/debris. If construction hasn't started within six months, the lot must be covered with decomposed granite or planted with irrigated grass.
- Exclusive hotel use restriction (expired): Until June 4, 2010, a separate hotel operator (Byrd) had exclusive rights to prevent competing hotel uses on SunCor's land south of Indian School Road and a first right of refusal to purchase that land. This restriction is now expired.
- Covenants & enforcement: These restrictions run with the land and bind all future owners. Default requires 20 days' notice to cure; failure may lead to injunctions or other remedies. Attorneys' fees go to the prevailing party in a lawsuit.
- What this document doesn't cover: This is a supplemental declaration for a single commercial parcel. It does not contain any rules for individual homeowners or tenants (e.g., pet policies, leasing terms, parking, or HOA assessments).
