Hacienda Hermosa Townhouses is a townhome community in Phoenix, AZ, where you own your individual lot and townhouse, with shared party walls and common areas maintained by the association. The rules bind owners and their tenants.
- What you own & maintain: You own your lot and townhouse, responsible for interior, exterior light fixtures, windows, doors, iron railings, gates, beams, poles, balconies, fireplaces, roofs, and landscaping inside lot walls. The association maintains stucco exterior walls, patio walls, front pony walls, painting of exterior walls and garage doors, common areas, parking, streets, and recreational facilities.
- Assessments & fees: Each lot pays annual and special assessments. Initial max annual assessment was $360; can increase up to 6% per year without vote, but no more than 15% in 3 years without a 2/3 owner vote. Special assessments require 3/4 board approval and 66% owner vote. Unpaid assessments become a lien and accrue $10/month surcharge.
- Leasing & rentals: Leases must be at least 90 days and in writing. No more than 2 leases per 12 months per lot. Only entire lots may be rented (to a single family). A maximum of 20% of lots (7) can be leased; new leases allowed only when below that cap, with a waiting list. Hardship exceptions possible for up to 1 year. Owners must submit rental forms and include a Crime Free Lease Addendum.
- Pets: Only commonly accepted household pets are allowed, kept for non-commercial purposes. No unreasonable noise or nuisance. Pets must be leashed outside the owner's lot. Board can determine if a pet is a nuisance or if the number is reasonable.
- Parking & vehicles: Permitted vehicles: passenger cars, golf carts, vans/pickups 3/4 ton or less. No commercial vehicles. Maximum 1 vehicle per driveway overnight (second with board approval). No overnight street parking (1am-4am). Trailers/boats must be in enclosed garage.
- Architectural review: Any exterior improvement (building, fence, wall, repainting) requires board approval of plans. Board has 45 days to approve/disapprove; if no response, approval is deemed granted but must still comply with other rules.
- Use restrictions: Residential use only. Home businesses are allowed if not detectable by sight/sound/smell, no customer visits, no signs. No nuisances. Signs limited to one name/address sign (9"x30"), for-sale signs, political signs (24"x24" allowed 45 days before election). No temporary structures or trailers used as residences.
- Party walls: Walls on the dividing line between units are party walls. Each owner bears half the cost of repair from non-negligent damage; the negligent owner pays if their act caused damage. Modifications require written consent of adjoining owner. Disputes go to binding arbitration.
