What Prescott Lakes's governing documents say
Prescott Lakes is a planned community in Mayer, AZ, governed by a master homeowners association. The community includes neighborhoods, each of which may have its own advisory committee or condominium association. Residents own their individual units (detached or attached) and share common areas and amenities. Rules are set by this Declaration, separate Use Restrictions, Architectural Guidelines, and Board-adopted rules.
- What you own & maintain: You own your unit (the land and improvements). The Association owns and maintains Common Areas and Limited Common Areas. Neighborhoods may have separate expenses and assessments for local amenities.
- Leasing & rentals: Leasing is allowed; the Association cannot prohibit leasing or require consent, but may impose a minimum lease term of up to 12 months and may require use of Association-approved lease forms. Tenants must comply with all governing documents.
- Architectural review: Any exterior changes or construction must be approved by the Architectural Review Committee (ARC) following the Architectural Guidelines. The Board adopts these guidelines and review procedures. Appeals are allowed.
- Assessments: Owners pay Master Assessments (for common expenses of all units) and Neighborhood Assessments (for benefits specific to a neighborhood). Special and Specific Assessments may also be levied. Assessments are a personal obligation and can become a lien.
- Use restrictions & rules: Use Restrictions are recorded separately and govern activities within units and on common areas. The Board may adopt, amend, or repeal Rules and Use Restrictions, subject to a 30-day notice and potential disapproval by a majority of Voting Members.
- Private amenities: The community has a Golf Course and an Athletic Club, both privately owned and operated. Use is on a club membership basis and is not automatically included in Association membership.
- Dispute resolution: Before filing a lawsuit, owners must follow a multi-step process: notice, negotiation, and mediation. The Association may initiate litigation after Board authorization.
