Broadway Mesa Commons Condominiums is a 13-unit condominium community in Mesa, AZ. You own your individual unit and share undivided interests in common elements (including parking areas, landscaping, and building exteriors), which the homeowners association maintains. The declaration also governs separate Parking Easements (NCP-1 and NCP-2) that share certain expenses.
- What you own & maintain: You own the interior of your unit; the association maintains all common elements (roof, exterior walls, parking surfaces, landscaping, etc.). Limited common elements (e.g., fenced rear storage area, roof HVAC equipment serving your unit) are for your exclusive use but maintained by the association unless damage is caused by you. You are responsible for maintenance of your unit's fencing and gate.
- Pets: No animals, reptiles, fish (except an aquarium inside your unit) or birds are allowed on the property without prior written board approval. Service animals for the handicapped are exempt.
- Leasing & rentals: Leases must be in writing, comply with all governing documents, and include a clause binding tenants to those documents. A copy of the lease and an environmental disclosure form must be submitted to the board before the lease begins. The association may charge a reasonable fee for review.
- Parking & vehicles: The board assigns two parking spaces per unit near its front entrance for exclusive use (these are not limited common elements). All other uncovered parking spaces are available for general use. Vehicles must be parked only in designated spaces; inoperable or abandoned vehicles may be towed at the owner's expense. No storage of trailers, boats, or campers unless inside a unit's fenced storage area.
- Architectural review: Any exterior change, addition, or alteration (including painting, fencing, awnings, signs, landscaping) requires prior written board approval. Submit plans to the board; if no response within 30 days, approval is deemed granted. No exterior television/radio antennas, outside speakers, or visible lighting without approval.
- Use restrictions: Units may only be used for uses permitted by zoning; certain uses are specifically prohibited (e.g., body shop, crematorium, adult-oriented business). No nuisances, hazardous materials, or activities that increase insurance rates. No open fires or burning. No structural changes without board approval.
- Assessments: Each unit pays a share of common expenses based on a 1/13 interest, except that expenses for landscaping, parking lighting, parking surfaces, and fencing are split: Parking Easements NCP-1 and NCP-2 each pay 1/15, and the remaining 13/15 is shared by the 13 units pro rata. The board may levy annual, special, and supplemental assessments. Delinquent assessments bear 15% annual interest and can become a lien on the unit.
