The covenant runs with the land and is binding on all current and future owners of Tracts A and B in the subdivision.
- Purpose & scope: The covenant requires that all areas defined as retention basins on the approved grading plan remain at the grades shown on that plan. No structure or obstruction may be built that would hinder storm water flow from public streets into these basins.
- Who is bound: The covenant runs with the land and binds the developer, all subsequent purchasers, and any occupier of Tracts A and B as shown on the final plat of the subdivision.
