Hermosa Del Sol Estates is a single-family residential subdivision in Mesa, AZ, governed by a homeowners' association (HOA). All lots are for single-family homes only, with strict architectural and landscaping controls to maintain a uniform, upscale character. This document applies to all lot owners and residents.
- Architectural review: All exterior changes—buildings, fences, landscaping, even paint—must be approved by the Architectural Control Committee. Plans must be submitted; if no response in 30 days, approval is deemed given. Exterior designs cannot be repeated within three lots on either side.
- Minimum home size: One-story homes must have at least 2,200 sq ft (R1-15 zone) or 2,000 sq ft (R1-9). Two-story homes require at least 1,500 sq ft (ground) + 1,000 sq ft (second) in R1-15, or 1,400 + 900 in R1-9. Garages, porches, decks, and patios are excluded from these totals.
- Parking & vehicles: Each home must have a 2-car enclosed garage. Driveways must fit two cars side by side. Overnight street parking is discouraged for owners. Commercial vehicles, buses, and construction equipment cannot be stored on lots; RVs, boats, and trailers must be screened from public view.
- Pets & animals: Only usual house pets allowed, with no commercial use. Swine, fowl, livestock, and bees are prohibited. Pets must be contained and controlled at all times.
- Landscaping & maintenance: Lots must be landscaped within 120 days of occupancy with at least three 15-gallon trees, one 24-inch box tree, and 70% grass/ground cover, plus an automatic sprinkler system. Desert landscaping is not allowed. Owners must keep lots clean, weed-free, and in good repair. Failure allows the committee to do the work and charge the owner.
- Fencing & walls: Back and side yards must be enclosed with a 6-foot masonry block wall, built before occupancy permit is issued. Front return walls must match the house material and color. All wall designs require committee approval.
- Use restrictions & business: Lots are for single-family residential use only. Home-based businesses are allowed only if consistent with City of Mesa ordinances. No signs (except one small for-sale sign), no temporary structures, no hazardous activities, and no antennas visible from the street without committee approval.
- Assessments & enforcement: The committee can assess costs for maintenance violations (e.g., landscaping) and enforce via lien or lawsuit. Assessments become a personal obligation of the owner and a lien on the property, subordinate only to first mortgages and property taxes. Interest accrues at 12% per annum on delinquencies.
