This is a declaration of covenants, conditions, and restrictions for a commercial property (Superstition Meadows Commercial Property) in Mesa, AZ. It binds the owners of commercial tracts (A, B, C, D, E) regarding landscaping maintenance, cost allocation, and enforcement. The declaration also grants enforcement rights to homeowners associations of adjacent residential communities (Ellingson-Lewis and Circle G).
- Landscaping maintenance & costs: Tracts C, D, and E must be used exclusively for landscaping. The owner of Tract A is solely responsible for maintaining Tract D's landscaping and irrigation; the owner of Tract B is solely responsible for Tract E; and costs for Tract C are split equally between Tract A and B owners. If a homeowners association takes over maintenance due to a violation, the maximum annual cost chargeable to the Tract A owner is $50 per month (adjusted by CPI), and to the Tract B owner is $100 per month (adjusted by CPI), or the actual cost, whichever is less.
- Enforcement & liens: If a violation occurs, the homeowners association (or an owner) must provide 30 days' written notice to cure. If not cured, the association may assume maintenance and charge the owner. Unpaid charges bear 18% annual interest and become a lien on the tract, subordinate only to first mortgages and property tax liens. The delinquent owner is also liable for attorney fees and collection costs.
- Term & amendments: The declaration runs until December 1, 2022, and automatically renews for successive 10-year periods. It can be amended by an instrument signed by at least 75% of the commercial property owners and the authorized representatives of the homeowners association(s) for the adjacent residential properties (or by the developer if no association is formed).
- What this document doesn't cover: This declaration does not cover residential rules, pet restrictions, leasing limits, or architectural review.
