La Jolla Acres Two is a standard single-family home subdivision in Paradise Valley, AZ. The document is a Declaration of Restrictions from 1974 that runs with the land and binds all lot owners. It describes what you can build and how you can use your lot, but does not create a homeowners association or impose fees.
- Residential use & lot rules: Each lot is for one single-story, single-family dwelling only. Lots cannot be subdivided smaller than the original plat. You may use one lot plus part of an adjacent lot as one building site.
- Building & height restrictions: Maximum one story, 20 feet from the highest finished natural grade. All structures must be new construction. A garage (attached or detached, up to 4 cars) is required; carports must be attached. Guest houses and servant quarters are allowed but must be architecturally consistent with the main house and used only by non-paying guests or servants employed on the property.
- Pets & livestock: No livestock, poultry, rabbits, or swine. Dogs, cats, or other household pets are allowed but cannot be kept, bred, or maintained for commercial purposes.
- Utilities & infrastructure: All electric and telephone wires must be run underground from the main lines to the residence; the lot owner pays for installation. Roof-mounted heating/cooling units are prohibited unless completely concealed from ground level.
- Vehicle & storage restrictions: No boats, travel trailers, or ground-mounted TV antennas may be stored on a lot unless completely enclosed by a fence or wall at least 6 feet high. No temporary structures (trailers, tents, etc.) are allowed. A dwelling cannot be occupied until construction is complete.
- Amendment & duration: The restrictions automatically terminate on January 1, 1990, unless extended by a majority vote of lot owners. Before 75% of lots are sold, the developer may amend without owner consent.
- What this document doesn't cover: The document does not create an HOA, set fees, or establish an architectural review committee. It also does not address leasing, short-term rentals, or parking on streets.
