Windscape is a single-family residential HOA community in Peoria, AZ, established in 1997. You own your individual lot and detached home; the association maintains designated common areas and enforces extensive architectural and use restrictions through assessments levied on each lot.
- What you own & maintain: You own your lot and the single-family dwelling on it. The association maintains the common areas (designated Tracts A–C) and carries liability and property insurance for those common elements.
- Architectural Control Committee approval: Nearly all improvements require prior written approval from the Architectural Control Committee: construction, landscaping, exterior colors, fencing, window coverings, HVAC units, and solar panels. The committee's judgment is final and binding; variances are available only at its discretion.
- Single-family use only: Only one detached single-family dwelling per lot is permitted (max 2 stories). No business, professional, or commercial use; no apartments, rental units, or mobile homes. Must have an attached garage for at least 2 cars.
- Landscaping & fencing rules: Front hedges and fences are limited to 3 feet; side and rear fences to 6 feet maximum. All fences must be masonry (no chain link without approval). Landscaping must be completed within 120 days of purchase, with an approved plan including ground cover.
- Vehicles & parking: Daily-use motor vehicles with current plates can be parked in driveways. Trailers, RVs, boats, aircraft, and recreational vehicles must be concealed from public view or stored in an enclosed garage. Vehicles cannot be left in a driveway for more than one week without written approval from the Architectural Control Committee.
- Pets: A reasonable number of domestic pets are allowed per local zoning requirements, and must be kept on a leash at all times outside yard fences. The Architectural Control Committee determines what qualifies as a house pet and whether the number kept is reasonable.
- Assessments & fees: Initial annual assessment is capped at $336 per lot. Annual increases are limited to the Consumer Price Index or 5% (whichever is greater), unless members vote to increase beyond that. A one-time working capital payment of 1/6 the annual assessment is due at purchase. Delinquent assessments incur 12% annual interest and up to 18% late charges.
- Enforcement & violations: The association can inspect lots and will issue a 14-day notice to cure violations. If not corrected, the association can take action at the owner's cost, creating a lien on the property. Common area access can be suspended if payment is 15+ days delinquent or violations aren't cured within 15 days of notice.
