Eagle Highlands North is a standard single-family home HOA in Phoenix, AZ, with 115 lots and common areas maintained by the association. All owners automatically become members of the homeowners association and must follow use restrictions, architectural rules, and pay assessments.
- Use restrictions: All lots are for single-family residential use only. No business or trade may be conducted from a home unless it is not detectable from outside and complies with zoning. No transient or hotel use; leases must be for at least 30 days and cover the entire lot.
- Rentals: Owners may lease their lots, but leases must be in writing, subject to the CC&Rs, and a copy must be given to the association before the term begins. The owner remains responsible for tenant conduct.
- Parking & vehicles: No commercial vehicles or recreational vehicles (campers, boats, trailers) may be parked in a front driveway or visible from other lots or streets for more than 24 consecutive hours. Street parking is limited to 24 hours. No inoperative or abandoned vehicles may be stored visibly. Standard pickup trucks used for business and personal use are allowed if signs are unobtrusive.
- Pets: Customary household pets (dogs, cats, birds) are allowed but must not create a nuisance or disturb others. The board can determine if a pet is a nuisance and require removal. Owners are liable for damage or injury caused by their pets.
- Architectural review: Any exterior alteration (building, fence, landscaping, solar collectors, antennas, satellite dishes, etc.) requires prior written approval from the Architectural Control Committee (ACC). Plans must be submitted; if not rejected within 45 days, approval is deemed given. The ACC considers aesthetics, harmony, and visibility.
- Assessments & fees: Each lot pays equal annual assessments. The initial maximum annual assessment is $40 per lot, increasing automatically by up to 10% or CPI annually. Special assessments for capital improvements require a 2/3 vote of members. Assessments are a lien on the lot. Late payments incur 12% interest and a $15 late fee.
- Fences & walls: Side and rear fences may be up to 6 feet 8 inches high, must be cement block construction, and color selected by the developer (cannot be changed without approval). Party walls (fences on lot lines) are jointly maintained by adjoining owners.
- Maintenance responsibilities: Owners must maintain their lot, house, and landscaping in good condition. The association maintains common areas, including drainage channels and certain easements. Owners must keep front yards landscaped within 3 months of purchase and maintain all landscaping. Failure allows the association to perform work and lien the lot.
